 YARMOUTH COUNTY MINOR HOCKEY ASSOCIATION

CONSTITUTION

ARTICLE ONE

Name

This association shall be called the Yarmouth County Minor Hockey Association (YCMHA).

ARTICLE TWO

Objectives

The objective of the YCMHA is to administer matters set out by Hockey Nova Scotia, Hockey Nova Scotia Minor Council and the Canadian Hockey Association. The YCMHA will foster, improve and perpetuate the game of minor hockey for member children, parents, volunteers and associate parties, of Yarmouth County, Nova Scotia.

ARTICLE THREE

Registration

A) The Yarmouth County Minor Hockey Association will register with Hockey Nova Scotia Minor Council and be recognized as a member association.

B) The YCMHA will operate in such a manner that is consistent with the Articles, By-Laws and Regulations of Hockey Nova Scotia, Hockey Nova Scotia Minor Council and the Hockey Canada.

C) The YCMHA shall submit a Constitution and By-Laws (Policies & Procedures) each year following its Annual General Meeting or with its annual player / official registration package to Hockey Nova Scotia Minor Council.

D) The YCMHA shall make available a list of officers following their Annual General Meeting to Hockey Nova Scotia Minor Council or any other interested party.

ARTICLE FOUR

YCMHA Board and Committee(s)

YCMHA has three standing bodies; the Board as a whole, the Executive and the Review Committee.

A) The YCMHA Board shall consist of the following directors:

President, Vice President, Past President, Secretary, “Rep” Treasurer, House Treasurer, “Rep” Ice Scheduler, House Ice Scheduler, Coaches Coordinator, Registrar, Ways and Means Director, Equipment Director, “Rep” Director, Timbits Director, Novice Director, Atom Director, PeeWee Director, Bantam Director, Midget Director, Female Player Director, Publicity Director, Fair Play Director.

B) Each officer shall carry one vote.

C) Non-Voting members are; Coach’s Mentor, 50/50 Fundraising Coordinator, Special Project Coordinator, Tournament Coordinator, and Referee in Chief.

D) The Executive of the YCMHA Board shall consist of the following; the President, the Vice President, the Secretary, the House Treasurer and the Rep Teams Treasurer.

E) The Review Committee shall be comprised of; the President, the Vice President, two Directors and a member of the public, approved by the Board at its annual meeting, to stand for that year.

F) The YCMHA shall hold an Annual General Meeting in May of each year. Special General Meetings may also be held at any time within the YCMHA year.

G) Four (4) weeks prior to the selected date of the Annual General Meeting, the date of Annual General Meeting will be advertised in a public manner (newspaper, web posting, etc.) for two consecutive weeks prior to the meeting.

H) Four (4) weeks prior the selected date of the Annual General Meeting, a Nominating Committee of three directors, will be struck to seek nominations to YCMHA Board. Only individuals identified by the Nominating Committee will be eligible to be elected as an officer in YCMHA. Nominated individuals will be in attendance at the Annual General Meeting. Each nominated individual will amass votes at this meeting and officers will be elected by total individual vote tally until all positions are filled.

I) All persons attending the Annual General Meeting, who are residents of Yarmouth County and are of legal age (19), have children eligible to be registered in the YCMHA system and/or where a registered coach in the past YCMHA year, upon paying the designated fee, may have one vote in the election of officers for the YCMHA Board. This fee is set at $1.00 in Canadian Funds, payable prior to voting.

J) The Executive of the YCMHA Board will be selected by secret ballot cast after the election of officers but during the Annual General Meeting. The Executive will sit for a term of one year. Executive(s) may be appointed for additional and consecutive terms.

K) At the Annual General Meeting, Directors, as identified in section (A), shall be identified and appointed by “majority rule” of elected officers at the meeting, including the Executive, to stand for that year. Director(s) may be appointed for additional and consecutive terms.

ARTICLE FIVE

Amendments

A) Constitution and By-Laws

Amendments or alterations to the Constitution or By-Laws may be made only at the Annual General Meeting of the YCMHA in the following manner:

a) By Special Resolution passed by a majority of not less than 50% plus 1, of the voting officers of the YCMHA, and as present at the Annual General Meeting of which notice has been given.

b) Notice of motion to amend the Articles or By-Laws must be provided to the Secretary of the YCMHA at least four (4) weeks prior to the Annual General Meeting at which it is to be considered.

B) Policy & Procedures

Amendments or alterations to the YCMHA Policies and Procedures may be made at any meeting of the YCMHA Board committee by simple majority vote.

C) Quorum

No meeting shall take place unless a quorum has been formed. A quorum shall consist of at least three-fifths (3/5’s) of the Executive committee, with 50% plus 1 of the YCMHA voting Officers present.

ARTICLE SIX

Boundary

The boundary for Yarmouth County Minor Hockey Association shall be deemed to be all lands within Yarmouth County, Nova Scotia, as defined by legal survey and shown on the map below.

BY-LAWS

BY-LAW 1

Membership

A) The Yarmouth County Minor Hockey Association shall conduct and supervise minor hockey for all players and officials registered with the YCMHA, as set out in Article Two of the YCMHA Constitution.

BY-LAW 2

Suspension and Expulsion of Officers

Any violation of the Articles, By-Laws and Regulations or decisions of HNSMC, HC, or YCMHA, shall render such an officer liable to suspension by a two/thirds (2/3’s) affirmative vote of the entire Board of the YCMHA until the next Annual General Meeting of the YCMHA. Any officer suspended shall be notified in writing for the reason of the suspension. Voting privileges of suspended officers shall also be withdrawn.

BY-LAW 3

Code of Conduct

The YCMHA shall be responsible for issues relating to conduct and discipline within their respective levels of hockey. All decisions and actions shall be at least consistent with the Regulations of HNSMC and HC.

BY-LAW 4

Registration

A) The YCMHA shall be responsible for registration of children within Yarmouth County, as defined in Article Six of the Constitution.

Documents shall be submitted to HNSMC as per instructions contained in the Regulations of HNSMC.

B) Children listed or registered in levels: Non-Competitive (house League) or Competitive (Rep Travel Teams) shall play in their respective Divisions.

C) The YCMHA shall be responsible for registering players and submitting HNS player cards (‘AAA’ only) and team registration. All other competitive and non-competitive teams shall be listed on the appropriate form provided by HNSMC and submitted with all fees associated with this registration.

D) Player registration fees shall be established prior to September 1st of each year.

E) Any additional competitive player registration fees will be established by the YCMHA Board.

BY-LAW 5

Compensation

A) Officers or other appointed persons shall receive reasonable expenses for hotel, meals, and transportation of car allowance, while on authorized business for the YCMHA. Such expense claims shall be submitted to the Board for approval.
